Prevention of Cruelty to Animals Act, 1960

The Indian Parliament passed the Prevention of Cruelty to Animals Act, 1960, which was written by famous dancer and animal lover Rukmini Devi Arundale. Its goals were to change the laws pertaining to the prevention of cruelty to animals and to stop needless suffering of animals.

Definitions: - In this Act, unless the context requires otherwise:-

1. Any domesticated animal or caught bird is referred to as a "animal";

2. A "street" is any public way, road, lane, plaza, court, alley, passageway, or open space that is accessible to the general public, whether or not it is a through-fare.

 

Prevention of Cruelty to Animals Act, 1960

• The Act's legislative goal is to "avoid inflicting unnecessary pain or suffering on animals."
•Under Section 4 of the Act, the Animal Welfare Board of India (AWBI) was founded in 1962.
•This Act penalizes people who inflict needless pain and cruelty on animals. The Act provides definitions for animals and their various forms.
• Outlines the policies around the use of animals in scientific research experiments; • Talks about the various types of cruelty, their exceptions, and the killing of an animal that is in pain in order to save it from more suffering.
• The Act codifies the rules governing the exhibition of performing animals and the offenses committed against them.

Prevention of Cruelty to Animals (Care and Maintenance of Case Property Animals) Rules, 2017

• The Prevention of Cruelty to Animals Act, 1960 served as the foundation for the 2017 Prevention of Cruelty to Animals (Care and Maintenance of Case Property Animals) Rules.
• A magistrate may, in accordance with the Rules, take back animals belonging to a defendant in an Act trial.
After that, the animals are given to hospitals, animal shelters, etc.; the authorities may even offer these animals for "adoption."
